The Center has attempted to provide accurate information and educational material, however, it must rely on third parties in many cases and therefore cannot warrant that its products or product descriptions are free of errors. By using any of the Center’s products/services you are hereby agreeing to be solely responsible for verifying the accuracy of any and all information/material found on the Center’s web site and/or in its products/services. In other words, by using this site and any of the products/services offered on it, you are agreeing to use the site and those products/services on an “as is” and “as available” basis and hold the Center harmless for any errors that may exist on its site and/or in its products/educational material/calendars.
You agree that any/all electronic communications between you and the Center will constitute a communication “in writing” as may be required by law. Postings on the Center’s web site shall also act as electronic communications and suffice as a communication “in writing.”
All copy, material, and software found on the Center’s web site, is owned either by the Center or its content suppliers and protected by U.S. and international copyright law. None of this material, copy, and/or software may be reproduced without written permission by the Center and/or its content suppliers.
Center for Futures Education, Inc., its logo/mark, and “the Center online” are trademarks or registered trademarks of Center for Futures Education, Inc. Use of the Center’s trademarks is prohibited without written permission from the Center. Any other trademarks found on the Center’s site are owned by their respective owners and are reproduced with their permission.
You are hereby granted a non-exclusive limited license to access and use the Center’s web site. This does not give you permission to alter, modify, or change the Center’s web site in any way. Certain areas of the site are accessible for free—enjoy. Other areas are intended to be accessible only upon payment. If you access areas that are available at a price without paying for them, you are committing larceny and will be prosecuted accordingly. If you want to resell any of the material on the Center’s site, a separate agreement is necessary. Contact the Center for such an agreement. You are also prohibited from framing the contents of the site and from using the Center’s name, trademarks, and/or logo within hidden codes or meta-tags without written permission from the Center. If you violate any of the conditions in this agreement, your license is automatically terminated. You are permitted to link to the Center’s web site as long as this is not done in a misleading, false, harmful, demeaning, or offensive manner.
In the event that you follow a link from the Center’s web site to someone else’s web site, the Center does not accept any responsibility for the content of the other person’s/firm’s web site, their products, or services. You are accessing their web site and using their products/services at your own risk.
If you use this site, and you establish an account with the Center, you are accepting full responsibility for keeping your user name and password confidential and for any misuse/expense that occurs as a result of any unauthorized use of this information.
Generally, the Center tries to ship its print version products out within three business days of the receipt of an order and good funds. Rarely, an order may have problems and may take longer to ship. Also, packages destined outside the United States may be lost by the U.S. Postal Service or returned to us after three months of travel around the world. If you do not receive your package within two weeks of ordering it, please contact us to verify that we received your order, that it was shipped, and that the carrier didn't lose it.
Most of the Center’s domestic print version product orders are shipped by United Parcel Service (UPS) and are automatically insured for $100.00. In the event that a product is shipped by UPS and it is lost, you may be called upon to verify that you did not receive the product. If you do not verify this, the loss will be yours. If you do verify the lack of receipt, the Center will file a claim with UPS and ship you another copy of the lost item(s). If the Center ships your products by the United States Postal Service (USPS) because you requested the Center to ship them this way or because the USPS is the only carrier servicing your area, then the risk of loss is yours upon our delivering the product to the USPS.
The Center has a no returns/no refunds policy. This means that hard copy products may not be returned after they have been opened. Electronic products may not be “returned” after they have been accessed. If you inadvertently ordered a hard copy of a product when you wanted an on-line version or vice versa, you can call the Center at (724) 458-5860 or e-mail the Center at and ask that the courses be exchanged. Assuming the materials have not been used/accessed, the Center will gladly do this and credit/debit your credit card for any difference in price between the two versions.
The prices listed in the Center’s store are established by the Center regardless of the source of the product. Quantity discount may apply under certain circumstances. Call for details. When ordering through the store, the shipping and handling amounts are calculated using either UPS’s shipper software, Miva Merchant’s UPS rate database, or the USPS’s software (for international shipments). In the event that there is an error in the shipping amount stated in the store, the Center reserves the right to contact you by e-mail or phone to inform you of the error and give you the opportunity to cancel your order or pay the “correct” amount as charged by either UPS or the USPS.
Parties other than the Center offer some of the same products the Center offers. The Center does not assume any responsibility or liability for the warranties expressed or implied, promises made, actions taken, or prices/services offered by those parties regarding the content of their web sites, products sold through them, or services rendered by them.
The Center does not make any representations or warranties as to the operation of its web site (which is not under its control), or the content found on its site (most of which is obtained from third parties). Therefore, you expressly agree to use the Center’s site at your own risk.
The Center hereby disclaims all warranties, express and implied (including warranties of merchantability and fitness for a particular purpose) with regard to its web site (www.thectr.com), information found on its site, products/services sold on its site, its web site servers, e-mails sent by the Center. In the event that the Center passes along a virus through its e-mails or from its web site, the Center will not be liable for any damages of any kind, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
By visiting www.thectr.com, you agree that the laws of the Commonwealth of Pennsylvania, without regard to principles of conflict of laws, will govern these Terms of Service and Conditions of Use and any dispute of any sort that might arise between you and the Center.
Any dispute relating in any way to your visit to www.thectr.com or to products or services sold or distributed by the Center or its web site shall be adjudicated in any state or federal court in Mercer County, Pennsylvania, and you consent to exclusive jurisdiction and venue in such courts.
